European Cookie Law Implementation Survey

For the second time, GVZH Advocates has participated in a study that has looked into the way in which Directive 2002/58/EC (the ‘Cookie Directive’), as amended in 2009 has been implemented across Europe. The latest version of the Directive requires that internet users grant their consent to the use of cookies on websites that they may visit.

Malta has implemented the Cookie Directive into its legislative framework, and the matter falls within the regulatory competence of the Information and Data Protection Commissioner.  The broad majority of other EU states have similarly implemented the Cookie Directive, with a few exceptions and with some other hybrid systems.

The report was drawn up in recent weeks and briefly sums up the situation across the EU, while shedding light on how individuals or entities operating across EU borders may find themselves affected by a few of the pecularities that exist insofar as the Directive has been implemented.

The study was conducted by Dr Michael Zammit Maempel, the firm’s practitioner on ICT and data privacy law; and the survey was coordinated by Bristows LLP with whom GVZH Advocates collaborates on technology, media and telecommunications matters.
